Welcome to Foxalo(the “Platform”, “Service”, “we”, “our”, or “us”). By accessing our website, creating a student account, or using our interactive language learning modules (including Dictation, Shadowing, Vocabulary SRS, Translation, and Speaking Reflex), you agree to be bound by these Terms of Service (“Terms”).

2. Learner Accounts & Eligibility
Account security, age requirements, and single-user access
Eligibility & Age
You must be at least 13 years of age (or 16 years old within the EU/EEA) to create an independent account. Users under this age must have verified parental or legal guardian consent.
Credential Confidentiality
You are solely responsible for maintaining the confidentiality of your credentials. Any activity conducted under your account is deemed performed by you.
Each Foxalo account is designated for single-learner personal use. Sharing login credentials, reselling access, or concurrent multi-device streaming for third-party commercial tutoring is strictly prohibited without explicit written authorization.
3. Code of Conduct, Anti-Cheat & Fair Play
Maintaining integrity, honorable competition, and community safety
Foxalo is founded on the belief that genuine language fluency requires honest, deliberate practice. To safeguard our weekly leaderboard tournaments and the gamified progression of all learners, we enforce a strict Zero-Tolerance Fair Play Policy.
Strictly Prohibited Exploitations & Actions:
- •Automated Scripts & Bots: Utilizing automated headless scripts, macros, or botting tools to spoof audio evaluations or rapidly farm XP and Gems.
- •API Tampering: Bypassing client-side controls, forging payload parameters (such as falsified quiz questions or inflated accuracy scores), or repeating lesson completion calls.
- •Abusive Content: Submitting vulgar, harassing, defamatory, or hateful text or audio through the AI speaking or translation prompts.
- •Reverse Engineering: Decompiling, reverse engineering, or extracting source code, proprietary algorithms, or seed datasets without authorization.
Foxalo servers monitor anomaly rates (such as impossible response velocities and duplicate submission patterns). Confirmed violations result in immediate XP deduction, leaderboard ban, or permanent account termination.
4. Foxalo Pro Membership & Billing
Pro plans, renewal by bank transfer, and how to stop it
Foxalo offers both free foundational access and upgraded Foxalo Pro premium subscriptions (monthly and annual plans). Pro members unlock unlimited AI feedback, deep grammatical breakdowns, advanced SRS decks, and ad-free study sessions.
You pay by VietQR bank transfer. Pro activates when SePay confirms to Foxalo that your transfer, with the payment code shown at checkout, has arrived.
All subscription fees are shown inclusive of applicable taxes unless specified otherwise at checkout.
Pro never charges you by itself. Foxalo reminds you 7, 3 and 1 days before the period ends; to keep Pro, you transfer again by VietQR through SePay. If you have set up a recurring transfer with your bank or SePay, each new period is added when the payment arrives.
To stop, cancel the recurring transfer on the bank or SePay side. Foxalo does not charge by itself, so Settings has no cancel button. You keep Pro until the paid period ends.

Eligibility Criteria for a Full Refund:
- The refund request is submitted within 7 calendar days of the original transaction timestamp.
- The request applies to your first Pro subscription purchase (not later renewal periods, including those paid by a recurring transfer).

6. Intellectual Property & Media Rights
Ownership of Foxalo assets, trademarks, and third-party educational media
Foxalo Proprietary Assets: All visual interfaces, Foxalo mascots, sound effects, learning curricula, SRS algorithms, codebases, and brand trademarks are the sole exclusive property of Foxalo. You receive a limited, revocable, non-transferable license to access learning content for personal non-commercial study.
Third-Party Curated Media: Video clips and authentic audio featured within Dictation and Shadowing exercises are sourced from publicly accessible educational channels (e.g., TED, news broadcasts, public domain media) via official platform APIs in compliance with educational Fair Use principles. All underlying rights remain with their respective creators and copyright owners.
7. AI Features & Educational Disclaimer
Nature of AI scoring, language feedback, and non-official status
Our real-time translation critique and speech pronunciation assessments are powered by state-of-the-art neural language models (Google Gemini and Groq AI). While these models offer remarkable pedagogical guidance, AI feedback is provided strictly for educational coaching and practice.
Educational Notice: AI evaluations, CEFR grade estimations, and pronunciation percentages do not constitute certified academic credentials or official IELTS, TOEFL, or TOEIC test certifications.
8. Limitation of Liability
“As Is” service provision and liability boundaries
To the maximum extent permitted under applicable law, Foxalo is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. Foxalo shall not be held liable for any indirect, incidental, punitive, or consequential damages resulting from service interruptions, internet instability, or third-party video unavailability.
Our total aggregate liability for any claim arising out of these Terms shall not exceed the total amount paid by you to Foxalo within the 12 months preceding the event.
9. Suspension & Account Termination
Grounds for termination and account deletion processes
You may stop using Foxalo at any time and request permanent account deletion via Account Settings or by emailing privacy@pingra.com.
We reserve the right to suspend, restrict, or permanently terminate your account without prior notice if you breach any provision of these Terms, engage in automated fraud or cheating, or compromise the security of other learners.
10. Governing Law & Support Contact
Jurisdiction and official communication channels
These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiations.
